Terms & Conditions

Payment Terms

  • Payment Terms. Brugel Creative can negotiate payment terms if you do not have the ability to pay in full upfront. Please contact us to find out more.
  • Additional Costs. Any additional unforeseen costs that may be agreed to during the development process will be invoiced as a seventh and/or final invoice upon the completion of the project.
  • Taxes. Brugel Creative are registered for GST. All our Australian customers will be subject to 10% GST. This amount is clearly shown on all Tax Invoices.
  • Remittance. Remittance should be made promptly by your business on or before the invoice due date. Invoice terms are 30 days from the date of issue.
  • Late Payments. If work for your business is in progress and an invoice is overdue, Brugel Creative will cease work until all accounts have been paid in full. If an invoice for a live website is more than 30-days overdue, Brugel Creative reserve the right to take the website offline until payment is received in full, or a payment plan has been agreed to.
  • Payment Withholding. your business has the right to withhold payment if in any case, Brugel Creative fails to deliver the product(s) according to the scope of work and the agreed timeframe (as outlined in the proposal).
  • Refunds. Brugel Creative do not issue refunds for services rendered. If for any reason your business is not fully satisfied with the work and service they have received, Brugel Creative may offer alternate compensation.

Scope of Work

  • Purchase. This online purchase acts as a contract between your business and Brugel Creative.
  • Project Commencement. Brugel Creative will commence the project for your business once payment has been received.
  • The scope of work. All due diligence has been taken by Brugel Creative to ensure the proposal is inclusive of all project requirements. If additional items are added to the scope during the project development, additional charges will apply and a final invoice issued.
  • Flexible working process. Should your business expectation or direction change or the delivery of necessary resources such as copy, imagery and photography to complete the project be delayed; Brugel Creative will suggest a flexible working process that may extend the time schedule of the original timeframe agreed.
  • Changes. Brugel Creative has the authority to carry out any changes if they are deemed necessary and will not impact your business content.
  • Additional Resources. All resources Brugel Creative will require to deliver your business brief have been included in the proposal, including, but not limited to; online resources and any plugins that may be necessary. There are no hidden costs in this quotation other than the varied nature of photography resourcing as outlined above.

Expectations

  • Timeframes. Should your business expectation or direction change, or the delivery of necessary resources such as copy, imagery and photography to complete the project be delayed; Brugel Creative will suggest a flexible working process that may extend the time schedule of the original timeframe agreed.
  • Communication. All information requested by Brugel Creative must be provided within 7 days, and please communicate if there will be any significant delays. Delays in responding to requests for information will impact the overall project timeline.
  • Project Delays. If a project is delayed significantly due to the client not responding promptly to any requests, a 15% additional fee will apply to your website costs.
  • Travel and Accommodation. No additional travel and accommodation costs have been included in the project estimate. Travel costs for meetings and/or training sessions that are not included in the proposal will be charged at an hourly rate of $120 p/h ex. GST. Accommodation required for meetings outside the Sydney or Newcastle CBD’s or surrounding suburbs, in regional locations or interstate locations not specified, will be charged at a reasonable cost.
  • Termination. Should either your business or Brugel Creative not be satisfied with the project, either party have the right to terminate the contract through written request. your business shall upon termination pay Brugel Creative all unpaid amounts due for services completed prior to the date of termination.
  • Termination Fee. In the unlikely event that your business does not adhere to timeframes and the project is significantly delayed as a result, Brugel Creative reserves the right to terminate the project agreement. The termination fees will be equivalent to the actual completion of any work provided and delivered to your business up to the date of termination.

Intellectual Property and Copyright

  • Original Design Files.Brugel Creative reserves the right to only provide the final design files to {{ clientBusiness }}. If working documents and/or original source documents are required, additional fees will apply unless otherwise stated in the proposal document.
  • Transfer of Copyright Ownership. Any and all items of Intellectual Property or Copyright either remain with your business or are transferred to your business upon completion of the project. Brugel Creative will not provide the ability to edit a website until a project has been completed and ownership has been transferred.
  • Joint Copyright Ownership. Any technical code or ‘plugin’ written to perform a function will be jointly owned, by your business and Brugel Creative.
